Plaintiff's first writ abated because it stated that a manor court in ancient demesne was 'king's court' when it should have stated 'queen's court'.
Plaintiff sued a special writ in Common Pleas to garnish defendant.
The record was before the Justices by the first writ, which was returned served.
Plaintiff prayed that the Justices examine the errors.
Martin JCP and Babington CJCP said that they were without warrant to do so.

Sjt Rolf argued that he could not have a new writ to the Suitors to bring the record into Common Pleas, because they had already done that and had been dismissed and discharged for this
Martin JCP distinguished between a writ of False Judgment in Common Pleas and a writ of Error in King's Bench. When a record from Common Pleas was removed into King's Bench by a writ of Error, brought by a Justice's hand, it was a record before and remained a record in King's Bench. But when a record came into Common Pleas by a writ of False Judgment, it did not become a record until it came into Common Pleas. |
