The writ was directed to the coroners, who served the writ.
Defendants appeared and pleaded not guilty.
It was found that defendant sheriff was not guilty and the other two defendants were guilty, and the damages were taxed at 20 pounds.
Plaintiff prayed judgment against the two other defendants, and had it.
Plaintiff prayed a Fieri facias to the sheriff to have execution.
Babington CJCP said that plaintiff could not have this writ, because the sheriff was party to the original writ.
Cokayn JCP told plaintiff to send a writ of Scire facias to the Coroners. |
