Plaintiff brought Scire facias on recovery in a writ of Covenant for failure to repair mills according to a composition by a deed indented.
Defendants demanded hearing of the composition.
Plaintiff replied that he had shown the composition by the record in the writ of Covenant.
Defendants passed over and pleaded the writ should have been brought against the two bailiffs and the commonalty of the vill.
After much discussion, it was adjourned. |

[12], fol. 75b-79b, 79b, the reporter said that in 2 Hen. 6 (marginal reference 2 Hen. 6, fol. 9), how the commonalty of a vill incorporated (corporat) by the name of a commonalty made a covenant to an abbot and to his successors, and then the abbot brought a writ of Covenant against them and recovered, and afterwards they (the commonalty) were more corporate, that is, the king enlarged their corporation by the name of the bailiffs and commonalty of such a vill, etc.; and then Scire facias was sued against them out of the aforesaid record, whether this will be sued against them on their old incorporation (corporacion), or on their later (darrein) incorporation (corporation) was well disputed
in 1490.019 = Pasch. 5 Hen. 7, pl. 7, fol. 24b-26a, the reporter said that Pasch. 2 Hen. 6, the case of the mayor and commonalty of Shrewsbury in a Scire facias, and when the composition and recovery happened (fuit), they were bailiff and not mayor; and see the same case adjudged, that he who made the obligation will be charged |
