It was awarded that plaintiff recover his damages as he counted, and not as taxed by the inquest.

Fitzherbert Verdict 1 was also dated 1424.032 = Mich. 3 Hen. 6, pl. 4, fol. 3a-5a: in Debt against executors the plaintiff counted of 40 marks and the inquest found that defendants had goods worth 40 pounds.
Brooke Dammages 181 stated that plaintiff counted of 10 pounds damages and the inquest found 15 pounds, but he recovered only 10 pounds damages.
