Process and Pleading
Plaintiff sued Scire facias on a recognizance made by defendant abbot John in the Exchequer.
The sheriff returned the writ well served.
Plaintiff prayed that defendant abbot be demanded.
One Robert appeared and said that John had been deposed and Robert had been chosen abbot of the same place and John was one of his monks.
Plaintiff prayed his judgment for defendant abbot John's default.
Juyn CBEx told plaintiff to sue his execution.

Juyn CBEx: plaintiff can sue execution against the deposed abbot and execute on the goods of the present abbot, but then the present abbot would bring a writ of Trespass against plaintiff which would turn on whether the former abbot was deposed before or after the writ of execution was brought.
I have conferred with the Justices of the one Bench and the Other, and their opinion is the same.
