Martin JCP: the essoin cannot lie because in this case the jurors will be amerced as in a Habeas corpus.
The clerks Broune and Heuster said the same.
And the justices were in great doubt whether the essoin would be quashed and Petty cape awarded or because if the essoin did not lie the tenant (defendant) will be demanded.
Another day, Martin JCP said that he had counseled with all the Justices of King's Bench and they held that in all cases where the essoin is not adjudged nor adjourned, if the essoun be quashed, he who was essoined will be demanded.
