Process and Pleading
Defendant was taken and brought to the bar for surety of the peace.
Defendant alleged that the record of his outlawry named him Preston, but he was named Presempt.
It was said for the king that defendant was the same person outlawed.
Defendant showed an indenture in which he was obliged by the name of Presempt, and brought 12 men of his parish to witness that his name was Presempt.
Plaintiff who prayed surety of the peace was demanded, and did not appear.
His averment was not maintained for the king.
Defendant was dismissed from Court
