Brief de Wast fuit port vers un que tient a terme de vie del lease un Alice, que graunt |
12 |
Defendant life tenant demanded to hear the deed that granted the reversion to plaintiff.
Hearing of the deed was granted.
Plaintiff replied that the lessor Alice enfeoffed plaintiff of the fee by a deed which he put forth, and defendant life tenant attorned.
Defendant life tenant imparled. |
Sjt Hals: Oye le fait del graunt del reversion |
Alice leased to defendant for a term of life. Alice then granted the reversion to plaintiff.
Sjt Lodington: If the lessor had ousted her life tenant, and then had made feoffment to plaintiff, and the life tenant had entered again on plaintiff after the feoffment, and had committed waste, plaintiff would not have this action, and this was said by all the Court.
The point of this report seemed to be a hypothetical situation asserted by Sjt Lodington and agreed upon by the Court. |
