Process and Pleading
Plaintiff counted that his ancestor leased a manor for a term of years, and assigned waste in a hall, kitchen, stable, and oaks.
Defendant pleaded plaintiff sold the hall to a prior who tore it down, the stable's timber was rotten and it fell down, the oaks were cut to build a new stable, and as to the rest 'no waste'.
Issue joined on all these points.

Statham Waste 41 stated that Hankford JCP said a tenant for life or years coiuld not cut oaks to build a new house, but could do so to repair another house; quaere whether, if a house fell in the lifetime of my father, his lessee could cut oaks to rebuild it in my time. Statham Barre 65 identified the buyer of the house from plaintiff's father as one 'B.', and added that Hill JCP said the situation would be different as to land in tail, which was agreed.
Fitzherbert Wast 59, dated 9 Hen. 4, stated that Huls JKB or Hill JCP (Huls) said that a tenant by copy of the court roll could not commit waste nor cut down trees to sell, except for his gain to repair his house.
