Debt against one, who came and said that he had made him a defeasance, which was such, that in the event that he alienated no land to sell, nor did anything else that could turn to his harm, without his counsel, that the obligation would not be effectual, but would lose its force, and he said that he had kept all the covenants. The plaintiff said that the defendant had alienated certain lands to a man, and also had made a statute merchant to another, so the covenants were broken, and the plaintiff prayed his debt. The defendant said that the plaintiff had taken various matters, and he prayed that the plaintiff hold to one, so that the issue could be taken on a certain point. Then he said that he had given certain land to his heir apparent, without taking anything, and he demanded judgment, and as to the statute, that could not turn to the plaintiff's harm, and he demanded judgment.
