Conspiracy was brought against several, supposing that by conspiracy among them, a certain one had forged a false deed, supposing that certain land was entailed to others, of which the plaintiff was tenant, so that the plaintiff who now was tenant was put to great labour and costs and expenses to defend himself, in selling these chattels. The defendants said that the plaintiff had not put with certainty the date of the deed, so that they could not have an answer to this, because this would be good reason, because the deed was good and lawful, and in case it were found otherwise, it would be cancelled (dampne). Cavendish JCP said, no more this deed than another. Fyncheden CJCP said that the making of the deed was not the whole cause of his action, but the false suit, and the making of the deed, agreeing this, it was nothing to the purpose the day or the date. Then the defendant challenged the writ, because it said that certain persons had procured (procuraverunt) a certain one to make and forge the deed, and he was the same person against whom the writ was brought, and he was named previously in the writ as one of those who should have procured, so he could not procure himself, judgment of the writ, and for this reason (ea de causa) it was abated.
