In a writ of Debt brought against executors, and the executor of their co-executor, the plaintiff counted of a contract made between him and the first testator, and because the writ was brought against executors, and the executor of their co-executor, and he did not show an obligation, he took nothing by his writ.
Noted in J.H. Baker & S.F.C. Milsom, Sources of English Legal History (London, Butterworths 1986), p. 210: it was settled that debt would not lie against executors unless there was a deed.
