Commentary & Paraphrase
One was taken for suspicion with certain goods, and then the person to whom the goods belonged sued an Appeal against him, and he was attainted at his Appeal, and the party was restored to his chattels. And at Newgate it was adjudged that, where one was taken at another Appeal, and was indicted for the same robbery, and arraigned, and held himself mute, the Justices inquired if this was by fraud, and this was found, and the person who sued the Appeal showed that he was taken at his suit. Therefore he would have his chattels.
