Bell<\/a><\/li>\n\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"wp-prepress-component-metabar-share js-bu-prepress-share-tools\">\n\t\t\t<span class=\"icon-twitter\"><span>Twitter<\/span><\/span>\n\t\t\t<span class=\"icon-facebook\"><span>Facebook<\/span><\/span>\n\t\t\t<span class=\"icon-action\"><\/span>\n\t\t<\/div>\n\t<\/div>\n<\/div>\n\n\t\n\n\n<p>Students taking Professor <a href=\"https:\/\/www.bu.edu\/law\/profile\/jessica-silbey\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jessica Silbey<\/a>\u2019s Creative Economies seminar delve into copyright and other intellectual property law questions that can ensnare fashion designers, professional chefs, and even tattoo artists.<\/p>\n\n\n\n<p>\u201cThat\u2019s a really contested space in copyright law: Can tattooers, who designed the tattoos but put them on other people\u2019s bodies, control the use of that tattoo once it\u2019s on another body?\u201d says Silbey, who is also a Yanakakis Faculty Research Scholar, a position established by the late Basil Yanakakis.&nbsp; \u201cWho owns the tattoo?\u201d By dispatching her students to tattoo parlors and ateliers to interview the artists about their concerns and disputes, she helps the future attorneys confront the law\u2019s ambiguities as they hone their interviewing and fact-gathering skills.<\/p>\n\n\n\n<div class=\"wp-block-bu-pullquote record-block-bu-pullquote alignwide is-style-pop has-quaternary-theme\"><div class=\"wp-block-bu-pullquote-inner\"><blockquote><div class=\"container-lockup\"><div class=\"container-icon-outer\"><div class=\"container-icon-inner\"><\/div><\/div><div class=\"container-text\"><hr\/><div class=\"quote-sizing\">That\u2019s a really contested space in copyright law: Can tattooers, who designed the tattoos but put them on other people\u2019s bodies, control the use of that tattoo once it\u2019s on another body? Who owns the tattoo?<\/div><footer class=\"caption\">Professor Jessica Silbey<\/footer><hr\/><\/div><\/div><\/blockquote><\/div><\/div>\n\n\n\n<p>\u201cIt\u2019s quite practical,\u201d she says, \u201cbut it\u2019s also theoretical because we ask questions about how law could be reformed to help these people. What parts of the statutory structure are working, and which ones aren\u2019t?\u201d Silbey\u2019s interest in creativity and IP inspired her 2015 book, <em>The Eureka Myth: Creators, Innovators, and Everyday Intellectual Property<\/em>.<\/p>\n\n\n\n<p>She began researching her next book, <em>Against Progress: Intellectual Property and Fundamental Values in the Internet Age<\/em>, as a 2018 Guggenheim fellow. Planned for publication in 2022, it explores how widespread copying and sharing of information in the digital age affects privacy, access to knowledge, and other aspects of social justice.&nbsp;<\/p>\n\n\n\n<p class=\"is-style-end-of-article\">A lifelong Bostonian, Silbey joined the BU Law faculty in 2021 after teaching at Northeastern and Suffolk universities.
