While that makes it fascinating for law students and practitioners, it also makes it challenging for people interested in entering the&nbsp;industry.&nbsp;<\/p><\/div><\/div>\n\n\n\n<p>As&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/fivethirtyeight.com\/features\/marijuana-legalization-is-super-popular-why-hasnt-it-happened-nationally\/\" target=\"_blank\">more states legalize marijuana<\/a>&nbsp;for medical and recreational use,&nbsp;demand&nbsp;is growing&nbsp;for attorneys who understand&nbsp;how to frame these new laws and how to help farmers&nbsp;and entrepreneurs negotiate them.&nbsp;The&nbsp;need for lawyers versed in these&nbsp;many&nbsp;rules and regulations\u2014all of which&nbsp;vary by state\u2014led to the creation of the <a href=\"https:\/\/www.bu.edu\/law\/experiential-learning\/externships\/\" target=\"_blank\" rel=\"noreferrer noopener\">Cannabis Law Externship<\/a> at BU Law.&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u201cStudents come to this externship with a broad background and are able to use all of their different skill sets and all of their knowledge of these different areas of practice\u2014it is a wonderful opportunity,\u201d says Director of Externship Programs <a href=\"https:\/\/www.bu.edu\/law\/profile\/kathleen-devlin-joyce\/\" target=\"_blank\" rel=\"noreferrer noopener\">Kate Devlin Joyce<\/a>, who helped develop the program with Professor&nbsp;<a href=\"https:\/\/www.bu.edu\/law\/profile\/jay-d-wexler\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jay&nbsp;Wexler<\/a> and Associate Dean for Experiential Education <a href=\"https:\/\/www.bu.edu\/law\/profile\/karen-pita-loor\/\" target=\"_blank\" rel=\"noreferrer noopener\">Karen Pita&nbsp;Loor<\/a>.&nbsp;<\/p>\n\n\n\n<p>The\u00a0idea\u00a0grew out of Professor Wexler\u2019s popular seminar, the <a href=\"https:\/\/www.bu.edu\/law\/courses\/lawjd969\/\" target=\"_blank\" rel=\"noreferrer noopener\">Law &amp; Regulation of Cannabis<\/a>, which examines criminal laws regarding cannabis and\u00a0the\u00a0banking, tax, and environmental laws that impact the industry.\u00a0\u201cWe wanted to get students involved with helping marijuana clients, particularly equity-based clients,\u00a0who could really use the legal advice to negotiate the regulatory process,\u201d\u00a0he\u00a0says.\u00a0<\/p>\n\n\n\n<aside class=\"wp-block-editorial-modal record-block-editorial-modal aligncenter js-bu-block-modal has-primary-theme\"><div class=\"wp-block-editorial-modal-callout\"><div class=\"wp-block-editorial-modal-media\"><figure class=\"wp-block-editorial-modal-image\"><\/figure><\/div><div class=\"wp-block-editorial-modal-callout-content\"><div class=\"modal-valign\"><h1>Teaching Cannabis<\/h1><p class=\"editorial-modal-callout-text\">Professor Jay Wexler discusses the conversation that led him to the field and the research that has come from it.<\/p><p><a href=\"#\" class=\"js-bu-block-modal-trigger-overlay button\">Read more<\/a><\/p><\/div><\/div><\/div><div class=\"wp-block-editorial-modal-content js-bu-block-modal-overlay\"><div class=\"overlay overlay-scale\"><a href=\"#\" class=\"wp-block-editorial-modal-overlay-close js-bu-block-modal-overlay-close\">Close<\/a><article>\n<p>A few years ago, when a publishing house representative asked Professor&nbsp;<a href=\"https:\/\/www.bu.edu\/law\/profile\/jay-d-wexler\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jay Wexler<\/a>&nbsp;if he knew of anyone who may need a new textbook about cannabis law, he thought, \u2018well, maybe me.\u2019&nbsp;<\/p>\n\n\n\n<p>\u201cI had been looking for a third course at the time, and it seemed really interesting,\u201d he says.&nbsp;&nbsp;<\/p>\n\n\n\n<p>A prolific and wide-ranging scholar, Wexler\u2019s research has focused on constitutional law, church\/state law, environmental law, and the areas of intersection among the three. If a state is considering legalizing cannabis and wants to raise revenue through its taxation, where should it set the rate?&nbsp;What if some lawmakers prefer higher taxes to disincentivize sales?&nbsp;\u201cIf you tax marijuana too high,&nbsp;then people go back to the illicit market and it undermines the whole system,\u201d Wexler says. \u201cI\u2019m hoping to isolate those criteria&nbsp;and draw out what results would lead to an ideal marijuana policy.\u201d&nbsp;<\/p>\n\n\n\n<p>Informing&nbsp;this work is research Wexler and Connor Burns (\u201919), who took the cannabis law seminar as a student, have conducted into prohibitionist&nbsp;anxieties&nbsp;that underpin&nbsp;recreational cannabis regulation, in&nbsp;particular the regulation of edible cannabis products.&nbsp;In a forthcoming paper,&nbsp;they argue&nbsp;that those anxieties&nbsp;have led many states&nbsp;to&nbsp;enact&nbsp;policies that do little to&nbsp;prevent&nbsp;the&nbsp;risks they intend to address\u2014namely,&nbsp;the&nbsp;overconsumption of edible products and unintentional consumption by minors\u2014while simultaneously&nbsp;restricting the cannabis market and&nbsp;making it more difficult for budding entrepreneurs.&nbsp;&nbsp;<\/p>\n\n\n\n<p>In the new and growing area of the law, there are plenty of issues to explore. While revenue collection and public health are important issues, it\u2019s access for consumers and opportunities for entrepreneurs\u2014particularly for equity applicants, or those from communities disproportionately impacted by the War on Drugs\u2014that Wexler really cares about.&nbsp;<\/p>\n\n\n\n<p class=\"is-style-end-of-article\">\u201cIt\u2019s been really hard for equity applicants to get a foothold in the industry, and one of the difficulties is access to legal representation to help negotiate these many regulations,\u201d Wexler says.&nbsp;\u201cI think that\u2019s an important part of&nbsp;researching, teaching, and practicing in this area.\u201d&nbsp;&nbsp;<\/p>\n<\/article><\/div><\/div><\/aside>\n\n\n\n<p>While the&nbsp;COVID-19&nbsp;pandemic prevented&nbsp;Josh Tabak (\u201921)&nbsp;from completing&nbsp;his&nbsp;externship&nbsp;with&nbsp;Portland, Oregon-based firm&nbsp;<a rel=\"noreferrer noopener\" href=\"http:\/\/www.margolislegal.com\/\" target=\"_blank\">Margolis Legal<\/a>&nbsp;in person, he could still gain experience and&nbsp;connections with the city\u2019s thriving cannabis industry&nbsp;remotely.&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u201cIt\u2019s a new field and it\u2019s constantly changing,\u201d he says, \u201cso getting the hands-on experience in my last semester was really important to me.\u201d&nbsp;<\/p>\n\n\n\n<div class=\"wp-block-image alignfarright\"><figure class=\"alignright size-full is-resized\"><img loading=\"lazy\" src=\"\/law\/files\/2021\/04\/Josh-Tabak.jpg\" alt=\"Josh Tabak ('21)\" class=\"wp-image-79189\" width=\"375\" height=\"375\" srcset=\"https:\/\/www.bu.edu\/law\/files\/2021\/04\/Josh-Tabak.jpg 400w, https:\/\/www.bu.edu\/law\/files\/2021\/04\/Josh-Tabak-150x150.jpg 150w, https:\/\/www.bu.edu\/law\/files\/2021\/04\/Josh-Tabak-344x344.jpg 344w, https:\/\/www.bu.edu\/law\/files\/2021\/04\/Josh-Tabak-300x300.jpg 300w, https:\/\/www.bu.edu\/law\/files\/2021\/04\/Josh-Tabak-100x100.jpg 100w\" sizes=\"(max-width: 375px) 100vw, 375px\" \/><figcaption>Josh Tabak (&#8217;21)<\/figcaption><\/figure><\/div>\n\n\n\n<p>Among Tabak&#8217;s projects was a survey of state programs&nbsp;that&nbsp;support&nbsp;participation in the&nbsp;cannabis&nbsp;industry by people disproportionately&nbsp;affected&nbsp;by the&nbsp;War on&nbsp;Drugs.&nbsp;\u201cWe wanted to see&nbsp;the impact of those programs,\u201d he says. \u201cI also looked at private organizations and nonprofits outside of the cannabis space that encourage some form of social equity, like Black Girls Code and programs encouraging urban farming,&nbsp;to see what might be transferable.\u201d<\/p>\n\n\n\n<p>While in many cases it\u2019s too early to tell,&nbsp;the early data suggests that social equity programs are falling short of their stated goals.&nbsp;\u201cOne of the problems is that marijuana is usually legalized by ballot initiatives, not through state legislatures, so then lawmakers are rushed to put regulations&nbsp;in place,\u201d Tabak says. \u201cIt takes time to set up&nbsp;social equity&nbsp;programs, but there\u2019s pressure to get licenses out immediately. For states that have a hard cap on licenses, the process is super&nbsp;competitive,&nbsp;and licenses tend to go to applicants with connections and money already in place.\u201d&nbsp;<\/p>\n\n\n\n<p>In the absence of federal legalization, banks have been reluctant to work with marijuana businesses, making financing a&nbsp;major&nbsp;hurdle (while&nbsp;<a href=\"https:\/\/www.reuters.com\/business\/us-house-representatives-approves-cannabis-banking-bill-2021-04-19\/\" target=\"_blank\" rel=\"noreferrer noopener\">a bill aimed at&nbsp;fixing that conflict<\/a>&nbsp;is making its way through Congress, it\u2019s unclear whether President Biden would ultimately support it). With many states using new marijuana markets as&nbsp;revenue generating opportunities, the cost to apply for a license can be very high, with some states requiring proof of $150,000 or more in capital just to apply, plus annual fees of up to $50,000. The amount and complexity of the paperwork and limits on the total number of licenses allowed by a state also serve to block participation in the industry.&nbsp;<\/p>\n\n\n\n<p>One way to&nbsp;promote equity in the industry&nbsp;would be to&nbsp;make the process of applying for a license less burdensome. \u201cWhen you look at the statistics [around social equity programs], they aren\u2019t really achieving what they were setting out to do,\u201d Tabak says. \u201cSo&nbsp;expanding those programs and incorporating more outreach would help, but so would just lowering the barriers to getting licenses in general.\u201d&nbsp;<\/p>\n\n\n\n<div class=\"wp-block-image alignfarleft\"><figure class=\"alignleft size-full is-resized\"><img loading=\"lazy\" src=\"\/law\/files\/2021\/04\/Quinn-Heath.jpg\" alt=\"Quinn Heath ('20)\" class=\"wp-image-79190\" width=\"375\" height=\"375\" srcset=\"https:\/\/www.bu.edu\/law\/files\/2021\/04\/Quinn-Heath.jpg 500w, https:\/\/www.bu.edu\/law\/files\/2021\/04\/Quinn-Heath-150x150.jpg 150w, https:\/\/www.bu.edu\/law\/files\/2021\/04\/Quinn-Heath-344x344.jpg 344w, https:\/\/www.bu.edu\/law\/files\/2021\/04\/Quinn-Heath-300x300.jpg 300w, https:\/\/www.bu.edu\/law\/files\/2021\/04\/Quinn-Heath-100x100.jpg 100w\" sizes=\"(max-width: 375px) 100vw, 375px\" \/><figcaption>Quinn Heath (&#8217;20)<\/figcaption><\/figure><\/div>\n\n\n\n<p>Quinn Heath (\u201920), who took Wexler\u2019s seminar in the fall and&nbsp;participated&nbsp;in the externship this spring, traces his interest in drug policy to an undergraduate internship with the Defender Association of Philadelphia\u2019s Adult Social Services department, where he helped nonviolent drug offenders prepare petitions requesting early release from prison. As an extern with the&nbsp;<a href=\"https:\/\/www.mensinggroup.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Mensing&nbsp;Law Group<\/a>, a&nbsp;Massachusetts-based&nbsp;firm that specializes in cannabis law, he\u2019s researched how clients can address a Cannabis Control Commission requirement that dispensaries create plans for positively impacting communities harmed by federal cannabis policies.&nbsp;&nbsp;<\/p>\n\n\n\n<p>After state regulations changed to allow for delivery, especially important for businesses during the pandemic, Quinn&nbsp;contributed&nbsp;updates&nbsp;to&nbsp;the firm\u2019s license application materials. \u201cAs an intern without a lot of cannabis law experience, it was a great way for me to dig in and start learning the regulations,\u201d he says.&nbsp;&nbsp;<\/p>\n\n\n\n<p>With so many facets of the business being&nbsp;so strictly&nbsp;controlled\u2014for example, bright colors and cartoon mascots are prohibited in advertising because some stakeholders are concerned about the products appealing to children\u2014there&nbsp;are plenty of details to&nbsp;resolve.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"is-style-end-of-article\">\u201cOne of the things I think is interesting about the cannabis field is that there are all of these different areas of&nbsp;debate&nbsp;and compromise,\u201d Heath says.&nbsp;\u201cThere&nbsp;are a lot of naysayers who are against cannabis because of the stigma&nbsp;in our country, but there are also a lot of people who are open to the tax revenues that come with these businesses.&nbsp;We can work out regulations that make&nbsp;everyone happy&nbsp;and help this industry thrive.\u201d&nbsp;<\/p>\n\n\n\t<aside class=\"wp-block-editorial-relatedstories
