Although the landscape of education has changed drastically since then, BU Law students Kelsey Scarlett (\u201921) and Lexi Weyrick (\u201921) argue that it has failed to meet the needs of modern students.<\/p><\/div><\/div>\n\n\n\n<p>The original framework has left behind marginalized groups, including people of color, people who identify as LGBTQIA+, individuals with disabilities, those who are lower-income, and those who do not have legal status in the US. A slew of <a rel=\"noreferrer noopener\" href=\"https:\/\/www.brookings.edu\/research\/analyzing-the-department-of-educations-final-title-ix-rules-on-sexual-misconduct\/\" target=\"_blank\">new Title IX rules<\/a>\u2014implemented by the Department of Education under former US Secretary of Education Betsy DeVos in August 2020\u2014further illuminate the law\u2019s issues and inequalities, Scarlett and Weyrick say.<\/p>\n\n\n\n<div class=\"wp-block-image alignfarright\"><figure class=\"alignright size-full is-resized\"><img loading=\"lazy\" src=\"\/law\/files\/2021\/04\/kelsey-scarlett-bu-law.jpg\" alt=\"\" class=\"wp-image-78803\" width=\"375\" height=\"450\" srcset=\"https:\/\/www.bu.edu\/law\/files\/2021\/04\/kelsey-scarlett-bu-law.jpg 500w, https:\/\/www.bu.edu\/law\/files\/2021\/04\/kelsey-scarlett-bu-law-287x344.jpg 287w, https:\/\/www.bu.edu\/law\/files\/2021\/04\/kelsey-scarlett-bu-law-441x529.jpg 441w\" sizes=\"(max-width: 375px) 100vw, 375px\" \/><figcaption>Kelsey Scarlett (&#8217;21)<\/figcaption><\/figure><\/div>\n\n\n\n<p>In a forthcoming article, they aim to address those issues and advocate for reimagining Title IX through an intersectional lens.<\/p>\n\n\n\n<p>\u201cTitle IX predominately focused on white women, and as people of color and those who are most marginalized started to enter into educational institutions, Title IX never really shifted to include those voices,\u201d Scarlett says. \u201cAnd so now we\u2019re at a point where these new rules definitely exacerbate the problems that arise with intersectional identities.\u201d<\/p>\n\n\n\n<p>While working with Clinical Associate Professor <a href=\"https:\/\/www.bu.edu\/law\/profile\/naomi-m-mann\/\" target=\"_blank\" rel=\"noreferrer noopener\">Naomi Mann<\/a> in the Access to Justice Clinic and as research assistants, Scarlett and Weyrick examined the new rules and various arguments opposing them. They presented their findings at a Title IX <a href=\"https:\/\/www.facebook.com\/FacultyAgainstRape\/posts\/1442061972663683\" target=\"_blank\" rel=\"noreferrer noopener\">symposium<\/a> earlier this year, where they spoke on a panel about litigation responses to administrative actions under former President Trump and former Secretary of Education DeVos.<\/p>\n\n\n\n<p>The heightened regulations included mandatory live hearings for sexual assault claims at universities. At these hearings, each witness is subject to cross-examination. The respondent and complainant also have a designated \u201cadvisor\u201d\u2014who can be anyone from a parent to an attorney\u2014to represent them in the hearing and conduct cross-examinations of the witnesses.<\/p>\n\n\n\n<p>This \u201ctrial-like\u201d process is unworkable for students, says Weyrick, whose research for the Access to Justice Clinic focused on the negative impact of live adversarial cross-examinations on complainants. &nbsp;<\/p>\n\n\n\n<p>\u201cPeople who hold marginalized identities are already disproportionately impacted [by sexual violence], and then this further silences people by being a barrier to reporting and participation,\u201d Weyrick says.<\/p>\n\n\n\n<div class=\"wp-block-image alignfarleft\"><figure class=\"alignleft size-full is-resized\"><img loading=\"lazy\" src=\"\/law\/files\/2021\/04\/lexi-weyrick-bu-law.jpg\" alt=\"\" class=\"wp-image-78804\" width=\"375\" height=\"450\" srcset=\"https:\/\/www.bu.edu\/law\/files\/2021\/04\/lexi-weyrick-bu-law.jpg 500w, https:\/\/www.bu.edu\/law\/files\/2021\/04\/lexi-weyrick-bu-law-287x344.jpg 287w, https:\/\/www.bu.edu\/law\/files\/2021\/04\/lexi-weyrick-bu-law-441x529.jpg 441w\" sizes=\"(max-width: 375px) 100vw, 375px\" \/><figcaption>Lexi Weyrick (&#8217;21)<\/figcaption><\/figure><\/div>\n\n\n\n<p>Now, Scarlett and Weyrick are working together to publish research that addresses the issues and inequalities in Title IX and advocates for a new system that works better for all students. Their research aims to reimagine Title IX in order to center the needs of survivors and address intersectional identities.<\/p>\n\n\n\n<p>Scarlett, who has accepted a position at <a href=\"https:\/\/www.shipmangoodwin.com\/people\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">Shipman and Goodwin<\/a> after graduation and hopes to do more Title IX work in the future, says she saw the importance of intersectionality in the legal system firsthand while she was working on an employment discrimination case in the clinic.<\/p>\n\n\n\n<p>\u201cWith the Access to Justice Clinic, you see how a lot of marginalized communities are impacted by stereotypes and impacted by lack of representation,\u201d Scarlett says.<\/p>\n\n\n\n<p>She then researched intersectionality and Title IX, focusing on women of color, who disproportionately experience sexual violence on campus and disproportionately underreport that violence. Scarlet notes that women of color\u2014and others with multiple marginalized identities\u2014may be uniquely affected by their experiences and loyalties to multiple groups.<\/p>\n\n\n\n<p>\u201cThe current system ignores the reality that discrimination, particularly through sexual misconduct, is based on more than one identity at a time,\u201d Scarlett and Weyrick write in their article, \u201cTransforming the Focus: An Intersectional Lens in School Response to Sex Discrimination\u201d (forthcoming in the <em>California Western Law Review<\/em>). \u201cAs a result, students are either forced to choose which of their identities to pursue a complaint under, or, even worse, the choice is made for them.\u201d<\/p>\n\n\n\n<p>In their paper, Scarlett and Weyrick advocate for an approach based on transformative and restorative justice instead of punishment. A focus on prevention and education, rather than discipline, is one shift they think could improve outcomes under Title IX.<\/p>\n\n\n\n<p>\u201cFor survivors to actually be able to get what they need out of a system, and for respondents to get what they need, schools have to completely reimagine the way they approach these issues,\u201d Weyrick says.<\/p>\n\n\n\n<div class=\"wp-block-bu-pullquote record-block-bu-pullquote is-style- has-image-focus-center-middle has-secondary-theme\"><div class=\"wp-block-bu-pullquote-inner\"><figure><\/figure><blockquote><div class=\"container-lockup\"><div class=\"container-icon-outer\"><div class=\"container-icon-inner\"><\/div><\/div><div class=\"container-text\"><hr\/><div class=\"quote-sizing\">It makes it really easy to keep going when you see how many people are ready to show up and ready to make change.<\/div><footer class=\"caption\">Lexi Weyrick (&#8217;21)<\/footer><hr\/><\/div><\/div><\/blockquote><\/div><\/div>\n\n\n\n<p>President Biden <a rel=\"noreferrer noopener\" href=\"https:\/\/www.natlawreview.com\/article\/title-ix-regulations-biden-administration-signals-changes-ahead\" target=\"_blank\">signed an executive<\/a> order in March indicating his administration\u2019s plan to change the Trump administration\u2019s regulations. Scarlett and Weyrick are hopeful that their research is a step toward reforming Title IX to better address survivors and marginalized groups.<\/p>\n\n\n\n<p>\u201cKelsey and Lexi are the future of Title IX and it has been my honor to work with them and see them grow,\u201d says Mann. \u201cThey demonstrate how powerful the work of law students can be in shaping and transforming how lawyers define equity.\u201d<\/p>\n\n\n\n<p>In the meantime, they support survivors and the <a href=\"https:\/\/www.bu.edu\/articles\/2021\/students-protest-university-handling-of-sexual-assault-cases\/\" target=\"_blank\" rel=\"noreferrer noopener\">BU student protestors<\/a> who are advocating for more protection under Title IX.<\/p>\n\n\n\n<p>\u201cWe believe survivors, and we are here for survivors, and we see them,\u201d Scarlett says.<\/p>\n\n\n\n<p>Weyrick, who hopes to spend her career fighting for Title IX reform, says she was inspired by the number of protestors who came together in February. She was also involved in Title IX activism before coming to law school, and <a href=\"https:\/\/www.huffpost.com\/entry\/campus-sexual-assault-progress_n_7470208?guccounter=1&amp;guce_referrer=aHR0cHM6Ly9iYXNlY2FtcC5jb20v&amp;guce_referrer_sig=AQAAAH48rbBI2TOiwl4-milAEPj-P40Z6kY3TwiN2wCQromg22QZUJjKmm-AS9d41lk_1e1NjTFVD-zwo3O8Z_9OcoXIRITj5jF_0\" target=\"_blank\" rel=\"noreferrer noopener\">helped reform how her undergraduate institution handled sexual assault claims<\/a>.<\/p>\n\n\n\n<p class=\"is-style-end-of-article\">\u201cIt makes it
