Instead, the researchers took aim at security vulnerabilities within a different app called Voatz, including the potential for hackers to change, prevent, or reveal how an individual has voted in an election.<\/p>\n\n\n\n<p>The public disclosure came after weeks of private discussions between the researchers\u2014PhD students Michael A. Specter and James Koppel and research scientist Daniel Weitzner\u2014and personnel from the Cybersecurity and Infrastructure Security Agency (CISA), a new entity within the Department of Homeland Security. Those discussions were facilitated by the Technology Law Clinic, which worked with the MIT researchers on how to disclose their findings. Through CISA the researchers were also able to share information with representatives of Voatz and officials in states that have already used or plan to use the app in elections.<\/p>\n\n\n\n<p>\u201cWe moved with some real haste in contacting CISA,\u201d says <strong>Andrew Sellars<\/strong>, director of the clinic, noting the \u201cnational significance\u201d of election-related security concerns. \u201cOur clients really wanted to be quite intentional with how they were handling their discoveries.\u201d<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright size-full\"><img loading=\"lazy\" width=\"500\" height=\"500\" src=\"\/law\/files\/2020\/03\/voatz-screenshot.jpg\" alt=\"Screenshot of the Voatz app\" class=\"wp-image-65938\" srcset=\"https:\/\/www.bu.edu\/law\/files\/2020\/03\/voatz-screenshot.jpg 500w, https:\/\/www.bu.edu\/law\/files\/2020\/03\/voatz-screenshot-150x150.jpg 150w, https:\/\/www.bu.edu\/law\/files\/2020\/03\/voatz-screenshot-344x344.jpg 344w, https:\/\/www.bu.edu\/law\/files\/2020\/03\/voatz-screenshot-300x300.jpg 300w, https:\/\/www.bu.edu\/law\/files\/2020\/03\/voatz-screenshot-100x100.jpg 100w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/figure><\/div>\n\n\n\n<p>Three BU Law students\u2014<strong>John Dugger <\/strong>(\u201921), <strong>Quinn Heath <\/strong>(\u201921), and <strong>Eric Pfauth <\/strong>(\u201920)\u2014were on the team helping the MIT researchers bring their findings about Voatz to light, and the work is already having an impact. On February 13\u2014the same day of the paper\u2019s release\u2014one Washington state county that planned to use Voatz had already decided against doing so. Not long after, <a href=\"https:\/\/www.nbcnews.com\/tech\/tech-news\/west-virginia-backtracks-using-smartphone-voting-app-state-primary-n1145571\" target=\"_blank\" rel=\"noopener noreferrer\">West Virginia dropped the technology<\/a>.<\/p>\n\n\n\n<p>\u201cIt\u2019s rewarding to see what we worked on have an impact,\u201d says Dugger, who started as a fellow in the Technology Law Clinic last summer. \u201cThe paper wouldn\u2019t have been released if it weren\u2019t for our assistance. It\u2019s great to know that we had a hand in that.\u201d<\/p>\n\n\n\n<p>After the MIT researchers signed on as clinic clients, the students, Sellars, and Visiting Clinical Assistant Professor <a href=\"https:\/\/www.bu.edu\/law\/profile\/tiffany-li\/\">Tiffany C. Li<\/a> began discussing how to responsibly reveal the vulnerabilities that were discovered in the voting app. Dugger says he and the other students examined relevant laws around software reverse engineering and security research. They also explored how best to utilize CISA, which was created in 2018 in part to counter election interference.<\/p>\n\n\n\n<p>\u201cAll in all, it was a very constructive discussion with CISA and affected elections officials,\u201d Sellars says. \u201cWe were quite happy with that process and with the substance of what we heard from them.\u201d<\/p>\n\n\n\n<p>Sellars says he found Voatz\u2019 response less satisfactory. After the paper\u2019s release, the company <a href=\"https:\/\/blog.voatz.com\/?p=1209\" target=\"_blank\" rel=\"noopener noreferrer\">posted a message on its blog<\/a>, claiming there were \u201cfundamental flaws\u201d with the MIT researchers\u2019 method of analysis. What they didn\u2019t do, Sellars notes, was say the researchers\u2019 findings were inaccurate.<\/p>\n\n\n\n<p>\u201cThey\u2019ve thrown up a lot of sand about the research,\u201d Sellars says. \u201cBut what\u2019s most telling is that they don\u2019t refute the findings. They haven\u2019t actually said \u2018that isn\u2019t true.\u2019\u201d<\/p>\n\n\n\n<div class=\"wp-block-bu-pullquote record-block-bu-pullquote alignwide is-style-modern has-image-focus-center-middle has-secondary-theme\"><div class=\"wp-block-bu-pullquote-inner\"><blockquote><div class=\"container-lockup\"><div class=\"container-icon-outer\"><div class=\"container-icon-inner\"><\/div><\/div><div class=\"container-text\"><hr\/><div class=\"quote-sizing\">We shouldn\u2019t subject people to untested experiments on their votes. A paper ballot is always going to be the most secure.<\/div><footer class=\"caption\">Andy Sellars<\/footer><hr\/><\/div><\/div><\/blockquote><\/div><\/div>\n\n\n\n<p>One reason government officials are so eager to embrace online voting technology is to make participating in elections easier for people with disabilities. A person who can\u2019t make it to the polls may more easily be able to cast their vote via a smartphone. But Sellars says accessibility shouldn\u2019t come at the price of individual privacy and election security.<\/p>\n\n\n\n<p>\u201cWe shouldn\u2019t subject people to untested experiments on their votes,\u201d he says. \u201cIf we\u2019re going to give them the vote, let\u2019s give them the vote. A paper ballot is always going to be the most secure.\u201d<\/p>\n\n\n\n<p>MIT scientist Weitzner agrees.<\/p>\n\n\n\n<p>\u201cWe all have an interest in increasing access to the ballot, but in order to maintain trust in our elections system, we must assure that voting systems meet the high technical and operation security standards before they are put in the field,\u201d he <a href=\"http:\/\/news.mit.edu\/2020\/voting-voatz-app-hack-issues-0213\" target=\"_blank\" rel=\"noopener noreferrer\">told MIT News<\/a>.<\/p>\n\n\n\n<p>(Sellars and Weitzner are not alone: In 2018, the National Academies of Sciences, Engineering, and Medicine <a href=\"https:\/\/www8.nationalacademies.org\/onpinews\/newsitem.aspx?RecordID=25120\" target=\"_blank\" rel=\"noopener noreferrer\">issued a report<\/a> calling on all US elections\u2014at every level\u2014to be conducted with paper ballots by 2020 to protect against security breaches.)<\/p>\n\n\n\n<p>The Technology Law Clinic regularly assists BU and MIT students whose work touches upon intellectual property, data privacy, civil liberties, or media and communications laws (another entity, the <a href=\"https:\/\/sites.bu.edu\/startuplaw\/\" target=\"_blank\" rel=\"noopener noreferrer\">Startup Law Clinic<\/a>, offers legal guidance for BU and MIT entrepreneurs). Although Technology Law Clinic students have handled so-called \u201cvulnerability disclosures\u201d in the past, the Voatz vulnerabilities were particularly high profile, especially coming so closely on the heels of the caucus app in Iowa.<\/p>\n\n\n\n<p>Visiting Professor Li, who worked closely with Sellars and the students on the Voatz research disclosure, says the case is a \u201cgreat example of the unique partnership between MIT and BU.\u201d<\/p>\n\n\n\n<p>\u201cMost student and early career cybersecurity researchers do not have access to free legal services,\u201d she says. \u201cIn addition to strengthening partnerships like the BU\/MIT clinics, we also need to think of new legal approaches nationwide to protect researchers like our clients.\u201d<\/p>\n\n\n\n<p>Dugger agrees, saying both technical know-how and legal expertise are needed to bring critical information to the public.<\/p>\n\n\n\n<p class=\"is-style-end-of-article\">\u201cWe\u2019re focused on different pieces
