While at CAR, she played a critical role in the drafting of several amicus briefs, including in a case in which the Massachusetts Supreme Judicial Court struck down life without parole sentences (LWOP) for young adults between the ages of 18 and 20.<\/p>\n\n\n\n<p>Now, Glass is building on those efforts as a clinical instructor for BU Law\u2019s <a href=\"https:\/\/www.bu.edu\/law\/experiential-learning\/clinics\/racial-justice-and-movement-lawyering-clinic\/\">Antiracism and Community Lawyering Practicum<\/a>, which is being offered for the first time this spring. Glass is co-leading the practicum with Professor <a href=\"https:\/\/www.law.uci.edu\/faculty\/full-time\/chang\/\" target=\"_blank\" rel=\"noreferrer noopener\">Robert S. Chang<\/a>, founder and executive director of the Fred T. The program, which provides full tuition scholarships to students who have demonstrated a commitment to antiracism, social justice, and racial equity, includes an experiential component, which can be fulfilled through Glass\u2019 practicum or through a racial-justice-focused project under Glass\u2019 direction within the <a href=\"https:\/\/www.bu.edu\/law\/experiential-learning\/clinics\/policy-drafting-clinic\/\" target=\"_blank\" rel=\"noreferrer noopener\">Legislative Policy &amp; Drafting Clinic<\/a>.<\/p>\n\n\n\n<div class=\"wp-block-bu-pullquote record-block-bu-pullquote has-image-focus-center-middle\"><div class=\"wp-block-bu-pullquote-inner\"><figure><\/figure><blockquote><div class=\"container-lockup\"><div class=\"container-icon-outer\"><div class=\"container-icon-inner\"><\/div><\/div><div class=\"container-text\"><hr\/><div class=\"quote-sizing\">We\u2019re thinking about how the law can be a tool for social change and, in particular, a tool for racial justice.<\/div><footer class=\"caption\">Caitlin Glass, Visiting Lecturer and Clinical Instructor <\/footer><hr\/><\/div><\/div><\/blockquote><\/div><\/div>\n\n\n\n<p>Much of the practicum\u2019s work is confidential, but, so far, students are writing amicus briefs, opinion pieces for mainstream news outlets, and talking points for social justice organizations. They may also help create resources about felony murder laws as part of <a href=\"https:\/\/felonymurderlaws.bu.edu\/\" target=\"_blank\" rel=\"noreferrer noopener\">a project Glass has been working on with several other organizations<\/a>, including the Felony Murder Elimination Project and Free Hearts. Glass regularly publicizes her legal research through popular media: some of her research on state felony murder laws was included on <a rel=\"noreferrer noopener\" href=\"https:\/\/felonymurderreporting.org\/\" target=\"_blank\">a website that accompanied a 2023&nbsp;<em>New Yorker<\/em>&nbsp;story by Sarah Stillman<\/a>.<\/p>\n\n\n\n<p>\u201cWe\u2019re thinking about how the law can be a tool for social change and, in particular, a tool for racial justice,\u201d Glass says.<\/p>\n\n\n\n<p>The practicum expands on BU Law\u2019s other experiential offerings, which are focused on equity and include\u2014in addition to practicums\u2014clinics, externships, and simulations. While Glass\u2019 practicum addresses anti-racism in its work with clients and partners, every clinic seminar at BU Law touches on issues of bias, racism, and\/or cultural competency.<\/p>\n\n\n\n<p>Although Glass and Chang\u2019s work on the LWOP brief, <a href=\"https:\/\/www.bu.edu\/antiracism-center\/files\/2023\/01\/Mattis-Amicus-Brief.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">which was filed in <em>Commonwealth v. Mattis<\/em><\/a>, predates the creation of the Antiracism and Community Lawyering Practicum, it is a good illustration of the kind of work the practicum will be involved in.<\/p>\n\n\n\n<p>In addition to the Center for Antiracist Research (represented by Glass and BU Law Associate Dean for Equity, Justice &amp; Engagement and Professor <a href=\"https:\/\/www.bu.edu\/law\/profile\/jasmine-gonzales-rose\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jasmine Gonzales Rose<\/a>) and the Fred T. Korematsu Center for Law and Equality, amici on the brief were the Center on Race, Inequality, and the Law at New York University and the Criminal Justice Institute at Harvard Law School. It argued that the Massachusetts high court should strike down LWOP sentences for young adults between the ages of 18 and 20 in part because of extreme racial discrepancies in how the sentence has been applied (a previous decision from the court had found the sentence unconstitutional for children under the age of 18). In a system rife with racial inequities, the application of LWOP for 18\u201320-year-olds is especially uneven: Black people are 16 times more likely than their white peers to be serving such a sentence at that age, the amici wrote in their brief.&nbsp;<\/p>\n\n\n\n<p>In January, <a href=\"https:\/\/static1.squarespace.com\/static\/5c671e8e2727be4ad82ff1e9\/t\/65a02032bb7b1761e82a160a\/1704992818671\/mattis-ruling.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">the court issued its ruling in <em>Mattis<\/em><\/a>, holding\u2014based on ample scientific evidence of differences between the brains of younger adults and older adults\u2014that LWOP for people who are 18-, 19-, or 20-years-old violates Article 26 of the Massachusetts Constitution, which prohibits \u201ccruel or unusual punishments.\u201d The ruling is the first of its kind in the country, striking down both mandatory and discretionary LWOP sentences for the age group. The court acknowledged Glass\u2019 amicus brief but did not specifically address race in its ruling.<\/p>\n\n\n\n<p>Still, Glass and Gonzales Rose say their brief was a way to draw public attention to the pervasive problem of racial bias in the criminal system. Additionally, in July, the <a href=\"https:\/\/www.bu.edu\/antiracism-center\/2023\/08\/02\/addressing-racialized-harms-of-incarceration-cars-caitlin-glass-testified-in-front-of-the-massachusetts-joint-committee\/\" target=\"_blank\" rel=\"noreferrer noopener\">brief was cited in testimony<\/a> to the Massachusetts Joint Committee on the Judiciary on bills that would address equitable sentencing for felony and joint venture murder and reducing mass incarceration.<\/p>\n\n\n\n<p>\u201cIt\u2019s really important to raise these extreme racial disparities so that the court can know about them, whether or not [the information] is ultimately in the opinion, but also for educating the public and other stakeholder advocacy groups,\u201d Gonzales Rose says. \u201cImpacted communities need to know about this.\u201d<\/p>\n\n\n\n<p>Chang, who is moving with his center to the University of California Irvine School of Law this summer, says he was impressed by Glass in her work on the <em>Mattis<\/em> and other briefs.<\/p>\n\n\n\n<p>\u201cShe&#8217;s not just thinking about the immediate brief or case,\u201d he says. \u201cShe&#8217;s thinking about how it fits into the bigger picture, choosing projects that advance this bigger picture.\u201d<\/p>\n\n\n\n<p><a href=\"https:\/\/www.linkedin.com\/in\/gisselamoya\/\" target=\"_blank\" rel=\"noreferrer noopener\">Gissela Moya<\/a> (\u201925) and <a href=\"https:\/\/www.linkedin.com\/in\/lucia-martinez-66b09087\/\" target=\"_blank\" rel=\"noreferrer noopener\">Lucia Martinez<\/a> (\u201925) are both ASPIRE students in the practicum. They recently helped draft an amicus brief addressing the admissibility of expert evidence about racism in a case impacting people serving wrongful and disproportionate convictions. <a href=\"https:\/\/www.ma-appellatecourts.org\/pdf\/SJC-13450\/SJC-13450_07_Amicus_CPCS_and_Others_Brief.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">In the brief in the case<\/a>, <em>Commonwealth v. Daniel Rogers<\/em>, the practicum students argued in favor of a Massachusetts criminal procedure rule that allows judges to reduce verdicts and that a lower court had wrongfully excluded neuropsychological evidence about the effects of racial violence against the defendant. In addition to the practicum and the Fred T. Korematsu Center for Law and Equality, the brief was joined by, among others, the Committee for Public Counsel, the Massachusetts Association of Criminal Defense Lawyers, the New England Innocence Project, and several evidence law scholars (including Gonzales Rose). &nbsp;<\/p>\n\n\n\n<p>\u201cLucia and Gissela did an incredible job drafting sections of this brief, doing legal research, and interviewing individuals whose stories illustrate the real-world impact of the decision that\u2019s before the court,\u201d Glass says.<\/p>\n\n\n\n<p>Moya says the practicum is \u201cvery inspiring.\u201d<\/p>\n\n\n\n<p>\u201cIt reminds you that there\u2019s something greater than being a lawyer\u2014it\u2019s being a part of movements, supporting great causes and people,\u201d she says. \u201cThe type of people in the practicum are very committed people who want to be creative about how to use the law for good.\u201d<\/p>\n\n\n\n<p>Gonzales Rose says the practicum is a \u201crich opportunity for students at BU Law to immerse themselves in antiracist lawyering.\u201d<\/p>\n\n\n\n<p class=\"is-style-end-of-article\">\u201cWe\u2019re thrilled to have this
