The American Journal of Law & Medicine is pleased to present this year’s symposium titled Preventive Care Law & Policy: Evolving Issues & Potential Consequences of Braidwood Management, Inc. v. Becerra. The symposium will be hosted at Boston University School of Law on February 23, 2024. The symposium will feature a keynote speech by Professor Abbe R. Gluck (Yale Law School, Yale Medical School), followed by four panels with speaker presentations and facilitated discussions.
Preventive care focuses on the health of individuals and communities and can include screenings, vaccinations, counseling, education, and overall well-being. A significant portion of preventive care policy has been developed and promulgated through delegation of authority to federal agencies to develop standards that address public policy and technical requirements. The ongoing Braidwood litigation presents an opportunity for the US Supreme Court to reconsider the nondelegation doctrine, the role of the appointments clause of the Constitution, and the scope of religious liberty pursuant to the Religious Freedom Restoration Act (RFRA) in the context of sexual and reproductive health care.
Symposium panels will explore the nondelegation doctrine and agency authority, preventive healthcare access, and the public health consequences that would likely result from Braidwood. Please reference the symposium agenda for additional information regarding the panels and presenters. Research presented at the symposium will be published in AJLM during the summer of 2024.
