That is the question the US Supreme Court will consider April 22 in<span>\u00a0<\/span><em>City of Grants Pass, Oregon v. Gloria Johnson<\/em>, when it will decide if local ordinances that punish people for sleeping outside (and for using items like a blanket, pillow, or box to protect themselves from the elements) are considered a \u201ccruel and unusual punishment\u201d under the Eighth Amendment.<\/p>\n<p>As researchers who have focused much of our work on the causes, consequences, and policy solutions to homelessness, we believe they are\u2014and legal experts, including the<span>\u00a0<\/span><a href=\"https:\/\/johnsonvgrantspass.com\/amici\" target=\"_blank\" rel=\"noreferrer noopener\">ACLU and National Homelessness Law Center<\/a>, make strong cases for this. Moreover, as social scientists who study the most effective responses to preventing and ending homelessness, we also see the case as a time to highlight what works (solutions that focus on housing) and what doesn\u2019t (punitive approaches) to address the nation\u2019s homelessness crisis.<\/p>\n<p>The<span>\u00a0<\/span><em>Grants Pass<span>\u00a0<\/span><\/em>case comes at a time when the number of people experiencing homelessness in the United States is at an all-time high. After a decade-long period of consistent declines in homelessness between 2007 and 2016, the number of people experiencing homelessness has grown each year since. Between 2022 and 2023 alone, the number of people experiencing homelessness at a given point in time<span>\u00a0<\/span><a href=\"https:\/\/www.huduser.gov\/portal\/sites\/default\/files\/pdf\/2023-AHAR-Part-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">increased by 12 percent<\/a>\u2014the largest single-year jump on record.<\/p>\n<p>Policymakers at all levels of government are facing increasing pressure to find solutions. In this context, some local officials\u2014including leaders in Grants Pass, Ore.\u2014have attempted to pursue policies that impose fines or jail time for people who bed down on city streets, even when no other alternatives are available. Their goal: deter people experiencing homelessness from staying in the city. Such approaches to homelessness have long been controversial, and the<span>\u00a0<\/span><em>Grants Pass<\/em><span>\u00a0<\/span>case will decide their fate.<\/p>\n<p>Local leaders argue that they need flexibility to implement laws like the one in question, so they can make progress reducing homelessness in their communities. But policies that criminalize people who are unhoused fail to address homelessness and exacerbate the harm it causes. In a recently submitted amicus brief that we endorse,<span>\u00a0<\/span><a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-175\/306641\/20240403145657027_23-175%20Amicus%20Brief.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">social scientists gathered evidence showing how the enforcement of anti-homeless laws harms individuals\u2019 health and exacerbates poverty<\/a><span>\u00a0<\/span>through exposure to environmental hazards, sleep deprivation, fines, incarceration, and lost and destroyed personal belongings. Criminalization measures like the ones enforced by Grants Pass fail to reduce homelessness in public spaces, make no significant impact on public safety, and fail to bridge people to shelters or other service programs that help them exit homelessness.<\/p>\n<p>What works instead? Research we have conducted shows that cities can tackle homelessness through policies that address its root causes. For example, our work shows that<span>\u00a0<\/span><a rel=\"noreferrer noopener\" href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1111\/j.1467-9906.2012.00643.x?casa_token=Nvp3abravf0AAAAA%3AmvU93-cn-clhdWCrVrtVxisH0rcm2FohHewEIJWVWvqtIH89iafsvrxaQ8Hz4_uVxGpi3VJ53fJk3A\" target=\"_blank\">as the cost of rent increases in a community, so does the size of its homeless population<\/a>, and rates of homelessness in a community<span>\u00a0<\/span><a rel=\"noreferrer noopener\" href=\"https:\/\/www.zillow.com\/research\/homelessness-rent-affordability-22247\/\" target=\"_blank\">begin to skyrocket<\/a><span>\u00a0<\/span>once the median rent in a community exceeds about 32 percent of the median household income. We\u2019ve shown that the impact of rental levels on homelessness persists when looking at<span>\u00a0<\/span><a rel=\"noreferrer noopener\" href=\"https:\/\/www.tandfonline.com\/doi\/abs\/10.1080\/07352166.2024.2308510\" target=\"_blank\">different measures of homelessness<\/a><span>\u00a0<\/span>and rates of homelessness within specific<span>\u00a0<\/span><a rel=\"noreferrer noopener\" href=\"https:\/\/ir.vanderbilt.edu\/handle\/1803\/18618\" target=\"_blank\">racial groups.<\/a><\/p>\n<p>Likewise, we have also documented<span>\u00a0<\/span><a href=\"https:\/\/journals.sagepub.com\/doi\/full\/10.1177\/0002716220981864\" target=\"_blank\" rel=\"noreferrer noopener\">how rising income inequality is contributing to growth in homelessness<\/a><span>\u00a0<\/span>via its impact on low-income renters. We\u2019ve also shown that increases across measures of local<span>\u00a0<\/span><a href=\"https:\/\/ir.vanderbilt.edu\/handle\/1803\/18618\" target=\"_blank\" rel=\"noreferrer noopener\">structural racism<\/a>\u2014namely inequities across housing, poverty, and criminal justice\u2014contribute to higher rates of homelessness among Black people.<\/p>\n<p>Cities need real solutions. Our colleagues at Boston University have shown that<span>\u00a0<\/span><a rel=\"noreferrer noopener\" href=\"https:\/\/www.bu.edu\/ioc\/2022\/01\/18\/mayors-and-homelessness\/\" target=\"_blank\">mayors feel accountable<\/a><span>\u00a0<\/span>to address the issue of homelessness, yet lack the tools to do so. But it\u2019s hard to see how allowing cities to criminalize homelessness will do anything to improve the structural conditions that are the real drivers of homelessness. Instead, communities should pursue solutions that prioritize the one thing that has consistently proven to be effective at addressing homelessness: housing.<\/p>\n<p>More concretely, we know that policies and programs that provide<span>\u00a0<\/span><a href=\"https:\/\/jech.bmj.com\/content\/73\/5\/379.abstract\" target=\"_blank\" rel=\"noreferrer noopener\">permanent, subsidized housing<\/a><span>\u00a0<\/span>or<span>\u00a0<\/span><a href=\"https:\/\/jamanetwork.com\/journals\/jamanetworkopen\/article-abstract\/2776100\" target=\"_blank\" rel=\"noreferrer noopener\">shorter-term financial assistance<\/a><span>\u00a0<\/span>can help people exit homelessness and keep them housed. And we know that, at scale, such strategies can lead to real progress in ending homelessness. Indeed, the US Department of Veterans Affairs has invested heavily in housing-led solutions to homelessness, resulting<span>\u00a0<\/span><a href=\"https:\/\/www.huduser.gov\/portal\/sites\/default\/files\/pdf\/2023-AHAR-Part-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">in a 52 percent decrease in veteran homelessness<\/a><span>\u00a0<\/span>between 2009 and 2023.<\/p>\n<p>Pursuing policies that have a broader effect on access to quality, affordable housing is also key. For example, our colleagues have demonstrated the critical importance of<span>\u00a0<\/span><a href=\"https:\/\/www.bu.edu\/ioc\/2023\/01\/18\/policy-brief-cities-zoning-and-the-fragmented-response-to-homelessness\/\" target=\"_blank\" rel=\"noreferrer noopener\">housing policies\u2014like land use and zoning<\/a>\u2014to help prevent and end homelessness in the long term. April is<span>\u00a0<\/span><a href=\"https:\/\/www.hud.gov\/FHM\" target=\"_blank\" rel=\"noreferrer noopener\">National Fair Housing Month,<\/a><span>\u00a0<\/span>which reminds us that we have tools to prevent race-based housing discrimination, redress histories of uneven urban development, and develop more equitable cities\u2014if we fully enforce our laws and implement our values.<\/p>\n<p>What can you do? First, you can learn more<span>\u00a0<\/span><a rel=\"noreferrer noopener\" href=\"https:\/\/johnsonvgrantspass.com\/\" target=\"_blank\">about the<span>\u00a0<\/span><em>Grants Pass<\/em><span>\u00a0<\/span>case<\/a><span>\u00a0<\/span>and how to participate in a<span>\u00a0<\/span><a rel=\"noreferrer noopener\" href=\"https:\/\/nlihc.org\/sites\/default\/files\/SCOTUS_Grants-Pass-V-Johnson_Advocacy-Toolkit.pdf\" target=\"_blank\">national week of action<\/a>. If you have family, friends, or colleagues in Washington, D.C., you could encourage them to attend<span>\u00a0<\/span><a rel=\"noreferrer noopener\" href=\"https:\/\/johnsonvgrantspass.com\/rally\" target=\"_blank\">the Housing Not Handcuffs: Johnson v. Grants Pass Supreme Court Rally<\/a><span>\u00a0<\/span>at the courthouse on the day of the oral arguments.
