In addition to the streams of refugees fleeing war in Syria, EU states are also seeing large numbers of refugees fleeing conflicts in Ukraine and Afghanistan. Many of these refugees fail to successfully seek asylum in Europe because states are not fulfilling their obligations to asylum seekers. The EU has facilitated this process, and in doing so, violates human rights standards.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Many EU member states, particularly those in the Mediterranean, are conducting illegal pushbacks of migrants. Greece is among the leading offenders. Between 2020 and May of 2022, the Greek authorities conducted just under <\/span><a href=\"https:\/\/www.hurriyetdailynews.com\/141-migrants-pushed-back-by-greece-rescued-178575\"><span style=\"font-weight: 400;\">42,000 pushbacks<\/span><\/a><span style=\"font-weight: 400;\">, and hundreds more asylum seekers have been found in the following months. In some cases, asylum seekers are found <\/span><a href=\"https:\/\/www.nbcnews.com\/news\/world\/92-migrants-found-naked-greece-turkey-border-un-urges-investigation-rcna52498\"><span style=\"font-weight: 400;\">stripped completely naked<\/span><\/a><span style=\"font-weight: 400;\">, other times their documents and personal belongings are <\/span><a href=\"https:\/\/www.nytimes.com\/2021\/07\/18\/world\/europe\/greece-migrants.html?searchResultPosition=4\"><span style=\"font-weight: 400;\">stolen<\/span><\/a><span style=\"font-weight: 400;\">. Beyond sending refugees\u00a0 \u2013including women and children\u2013 back out to sea, Greek authorities have also pushed asylum seekers across the <\/span><a href=\"https:\/\/www.nytimes.com\/2022\/02\/24\/world\/europe\/greece-turkey-migrants-deaths.html?searchResultPosition=1\"><span style=\"font-weight: 400;\">Turkish border<\/span><\/a><span style=\"font-weight: 400;\">. Theft of dignity is not the only consequence of asylum pushbacks \u2013 many asylum seekers <\/span><a href=\"https:\/\/www.nytimes.com\/2022\/02\/02\/world\/europe\/greece-turkey-migrant-deaths.html?searchResultPosition=2\"><span style=\"font-weight: 400;\">die<\/span><\/a><span style=\"font-weight: 400;\"> as a result of Greek policies. Despite mounting evidence, Greece repeatedly <\/span><a href=\"https:\/\/www.nytimes.com\/2022\/02\/24\/world\/europe\/greece-turkey-migrants-deaths.html?searchResultPosition=1\"><span style=\"font-weight: 400;\">denies<\/span><\/a><span style=\"font-weight: 400;\"> any violations of human rights. Greece is not the only Mediterranean state guilty of conducting such pushbacks. Italy, led by a far-right government, fails to allow asylum seekers onto their shores, leaving them <\/span><a href=\"https:\/\/www.dw.com\/en\/italy-rescue-ship-impasse-ends-as-migrants-come-ashore\/a-63690018\"><span style=\"font-weight: 400;\">stranded at sea<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">States have a number of legal mechanisms to avoid admitting refugees into their borders. Mediterranean states work with Libya, the origin of many sea-based refugee routes, to <\/span><a href=\"https:\/\/www.nytimes.com\/2020\/03\/20\/world\/europe\/mediterranean-libya-migrants-europe.html?searchResultPosition=1\"><span style=\"font-weight: 400;\">capture and return refugees<\/span><\/a><span style=\"font-weight: 400;\"> to the <\/span><a href=\"https:\/\/www.newyorker.com\/magazine\/2021\/12\/06\/the-secretive-libyan-prisons-that-keep-migrants-out-of-europe\"><span style=\"font-weight: 400;\">inhumane conditions<\/span><\/a><span style=\"font-weight: 400;\"> found in Libyan refugee camps before they reach European waters. If refugees never make it to European territory, they cannot claim asylum in Europe. The EU seemingly seeks to catalyze this process by <\/span><a href=\"https:\/\/euobserver.com\/migration\/156446\"><span style=\"font-weight: 400;\">placing rules on charity and NGO boats<\/span><\/a><span style=\"font-weight: 400;\"> that rescue asylum seekers and bring them to European territory. This would follow <\/span><a href=\"https:\/\/euobserver.com\/migration\/156446\"><span style=\"font-weight: 400;\">Italian legislation<\/span><\/a><span style=\"font-weight: 400;\"> that prevents entry of NGO boats into Italian waters.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">EU countries can also deny asylum claims on grounds of inadmissibility. States base these claim denials on the existence of \u201c<\/span><a href=\"https:\/\/www.infomigrants.net\/en\/post\/39545\/eu-when-an-asylum-claim-is-inadmissible\"><span style=\"font-weight: 400;\">safe third countries<\/span><\/a><span style=\"font-weight: 400;\">\u201d, a principle that allows governments to deny asylum claims so long as there is another safe state where a refugee can claim asylum. A notable example of this is Turkey. Turkey has \u201csafe third country\u201d designation, and hosts over <\/span><a href=\"https:\/\/www.hrw.org\/news\/2022\/11\/17\/why-eu-cant-count-turkey-protect-asylum-seekers\"><span style=\"font-weight: 400;\">3.9 million refugees<\/span><\/a><span style=\"font-weight: 400;\">, largely motivated by the 6 billion euros the EU sent Turkey to accept the refugees they did not want to admit. However, Turkey has a notable lack of its own asylum procedures, in addition to its blatant disregard for nonrefoulment principles, evidenced by its <\/span><a href=\"https:\/\/www.hrw.org\/news\/2022\/11\/17\/why-eu-cant-count-turkey-protect-asylum-seekers\"><span style=\"font-weight: 400;\">forced return of many Afghan refugees<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Most European states are guilty of adopting such policies. Aside from those states on the Mediterranean route, numerous states such as <\/span><a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2021\/10\/eu-new-evidence-of-systematic-unlawful-pushbacks-and-violence-at-borders\/\"><span style=\"font-weight: 400;\">Poland, Spain, and Croatia<\/span><\/a><span style=\"font-weight: 400;\"> are culpable for violent responses to refugees. As a <\/span><a href=\"https:\/\/op.europa.eu\/webpub\/com\/eu-what-it-is\/en\/\"><span style=\"font-weight: 400;\">union between countries and <\/span><i><span style=\"font-weight: 400;\">not <\/span><\/i><span style=\"font-weight: 400;\">its own sovereign state<\/span><\/a><span style=\"font-weight: 400;\">, the EU is in a unique position to influence the policies of its member states. Asylum is, one will note, a human right protected under the <\/span><a href=\"https:\/\/home-affairs.ec.europa.eu\/policies\/migration-and-asylum\/common-european-asylum-system_en\"><span style=\"font-weight: 400;\">Geneva Convention<\/span><\/a><span style=\"font-weight: 400;\">. Under this principle, individual states throughout the EU have the obligation to ensure asylum for those who seek refuge. The obligation to ensure asylum is further enshrined under <\/span><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A12012P%2FTXT\"><span style=\"font-weight: 400;\">Article 18<\/span><\/a><span style=\"font-weight: 400;\"> of the Charter of Fundamental Rights of the European Union, which directs member states to grant asylum per Geneva Convention criteria. This is a clear call to action for EU member states, which the EU has the responsibility to enforce and uphold.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The EU has taken actions in the past to support the humanitarian rhetoric laid out in the Charter. In 1999, for example, the EU developed the<\/span><a href=\"https:\/\/home-affairs.ec.europa.eu\/policies\/migration-and-asylum\/common-european-asylum-system_en\"><span style=\"font-weight: 400;\"> Common European Asylum<\/span><\/a><span style=\"font-weight: 400;\"> system to mitigate uneven flows of refugees into the EU, and supposedly, ensure the fair treatment of asylum seekers. However, this directly opposes the actions of Frontex, the EU\u2019s border agency that acts as a mechanism to keep refugees out. Frontex has allegedly helped <\/span><a href=\"https:\/\/www.nytimes.com\/2020\/11\/26\/world\/europe\/frontex-migrants-pushback-greece.html?searchResultPosition=1\"><span style=\"font-weight: 400;\">cover up the human rights violations <\/span><\/a><span style=\"font-weight: 400;\">originating from Greece\u2019s pushbacks, and the European Commission, who oversees Frontex, has <\/span><a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2021\/10\/eu-new-evidence-of-systematic-unlawful-pushbacks-and-violence-at-borders\/\"><span style=\"font-weight: 400;\">funded<\/span><\/a><span style=\"font-weight: 400;\"> violent border practices in Croatia. Frontex has also framed the <\/span><a href=\"https:\/\/www.nytimes.com\/2022\/03\/02\/magazine\/greece-migration-ngos.html?searchResultPosition=10\"><span style=\"font-weight: 400;\">narrative<\/span><\/a><span style=\"font-weight: 400;\"> that NGOs directly aid smugglers, before acknowledging that such collusion was unintentional \u2013 even with this acknowledgement, NGOs still suffer the fallout of Frontex\u2019s initial accusation, facing legal battles and other obstacles to performing their work.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The EU has the power to make positive changes for refugees; the institution has already enacted pro-refugee policies, albeit ones that don\u2019t seem to make much of a difference for asylum seekers today. However, the EU elects to support the human rights violations conducted by its member states instead of enforcing the humanitarian precedents laid out in official EU literature. The EU must reckon with the harm it has wrought through Frontex and the European Commission and adjust its policies to protect the human rights principles its member states have all agreed to uphold. <\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>As the principal governing body in Europe, the EU has a unique obligation to protect asylum rights, which it is currently failing.\u00a0 EU asylum claims are currently the highest they have been since 2015.
