Curbing Corporate Harm: Lessons Learned from Tobacco Litigation & Regulation
The for-profit corporation, one of the dominant institutions of our times, has no general legal obligation to the well-being of society or to individual consumers. For-profit corporations will seek profit for their stockholders using all legal means available, and the pressures imposed by stock-based compensation schemes and financial markets often lead corporations to indulge in reckless, irresponsible, and environmentally destructive behaviors. What can tobacco litigation and tobacco regulation teach us about curbing the environmental harm caused by corporations?
