  1. If imposing a death sentence is a value judgement, than it doesn’t make sense to ask who is “qualified” to make that judgement. The idea that the legal rules can take the value judgement out of the process is why we still have the death penalty in this county while all of our peer countries abolished it long ago.

    1. It’s also problematic to refer to “shared values.” One of those values is whether the death penalty is warranted under any circumstances. Those that agree it can ever be warranted disagree on when and many others think it is never warranted.
