A Note on Independent Contractors
Before engaging an individual, (or a company with only one employee) to do work for the University as an “independent contractor,” “consultant,” “freelancer” or “vendor,” you must evaluate whether he or she should be classified as an Employee OR Independent Contractor.
Employee v. Independent Contractor
Individuals who perform services are presumed to be employees unless the IRS and Massachusetts standards are satisfied. Decisions must be based on compliance with the legal standards, not administrative ease, budget constraints or funding guidelines.
Steps for Classification
- Units will initiate classification decision by completing and having the worker complete the ‘Worker Classification Pre-Qualifying Questionnaire’ available from the Comptrollers’ Office
- Accounts Payable will review the documentation
- Comptroller will review situations that are unclear or need further review
