New Sexual Misconduct Policy and Procedures

Changes to BU’s Sexual Misconduct Policy and Processes

On August 14, 2020, the University implemented a new Sexual Misconduct Policy. The changes were required by new Title IX regulations published in late May by the United States Department of Education (DOE), the federal department charged with oversight and enforcement of Title IX, a federal statute that prohibits discrimination on the basis of sex in any federally funded education program or activity.  The new regulations mandate how colleges and universities investigate and adjudicate sexual misconduct cases under Title IX, and requires all colleges and universities to amend their Title IX policies and procedures to reflect those changes by no later than August 14, 2020.

In order to ensure BU remains a safe and welcoming place for living, learning, and working, the University will continue to adjudicate sexual misconduct complaints that fall outside the narrow scope of the new Title IX regulations. For misconduct that is covered by Title IX, the University’s procedures have been updated to comply with the new regulations.

The Policy and its accompanying Procedures apply to conduct that occurs on or after August 14, 2020.

The Policy has three corresponding Procedures:

Although the new regulations require the University to amend its processes for adjudicating certain types of sexual misconduct, BU remains committed to fostering a safe, healthy, and nondiscriminatory environment free from sexual misconduct for all members of our community. The University continues “to work toward reducing the rate of sexual misconduct in our community through both prevention efforts and vigorous enforcement of our Sexual Misconduct/Title IX Policy.

Community members should familiarize themselves with the new Policy and corresponding Procedures. An FAQ below in this webpage will be continuously updated to address questions from the community.
