Huse CJKB: when an original writ ought to be commenced in Court Chrisian (ecclesiastical court), and commences there, even if afterwards something comes in issue that is triable by our law, yet it will be tried by their law (canon law) (comity principle); as if one sues for a horse devised to him in Court Christian (testamentary cause), and the defendant pleads that the devisor (testator) in his lifetime gave him (defendant) the horse, this is triable by our law, yet this will be tried by the (canon law), etc.; and it is the same law where an original (writ) commences in our law (for) a thing triable by the Law of Holy Church (canon law), it will be tried by our (law), as in Quare impedit (the issue) able or not able in a dead person (professed religious) will be tried by our law; and where the original (writ) commences in England and the rest (rem-) will be performed in another land (auter terre, abroad), yet it will be tried here; as if one make a bargain with another to serve him on the sea (sur le mer), or overseas (par de la), or to purchase bulls in Rome, the action will be brought in England well enough, and tried (here), etc.; as if an action be brought, and a birth (un naistre) is alleged (by defendant to have occurred) overseas (par de la), and the plaintiff alleges birth at such a place within England, he (plaintiff) will not take a denial (Sans ceo) (of the birth at some place outside the realm) etc.; and so the defendant ought to maintain the birth overseas (perdela), and traverse the birth within England
and his (Huse CJKB's) opinion was that he who is born overseas (ne par de la), and his father and mother were English, their issue inherit by the common law, but the statute makes clear (that children born abroad of the king's subjects would inherit) (25 Edw. 3 (1351), stat. 1 or 42 Edw. 3 (1368), ch. 10)
