Process and Pleading
The sheriff in his account of green wax prayed allowance for certain issues and amercements forfeited in Common Pleas by a tenant of the Duchess of York.
In Exchequer, plaintiff Duchess of York showed the court the king's letters patent and showed that the issues etc. ought to be levied by herself or by her servants.
Argument whether the king's grant to the duchess granted to her issues and amercements forfeited in the king's court.
The King's Attorney argued that the grant did not convey the issues and amercements it purported to convey.

Abstract Context
Joan [nee Joan Holland], duchess of York, d. 1434, in s.v. Willoughby family, perh. c. 1300-1523, in Oxford DNB. Richard Plantagenet , born 1411, was styled Duke of York from 24 Feb. 1425 until 30 Dec. 1460; Edward 'of York' was Duke of York from 1 Aug. 1402 to 25 Oct. 1415, s.v. Edward [Edward of Langley, Edward of York], second Duke of York, c. 1373-1415, in Oxford DNB. William Tresham was an Apprentice who never became Serjeant and spoke also in 1430.074 = Mich. 9 Hen. 6, pl. 28, fol. 451-46a and 1436.060 = 14 Hen. 6, pl. 60, fol. 19b-21a and 1436.078 = 14 Hen. 6, pl. 78, fol. 26b (died in 1450; Baker, Readers and Readings, p. 15)
Commentary & Paraphrase
The king (Hen. 5, c. 1415) granted the Duchess of York a certain island (Isle of Wight) and a certain castle (Carisbrooke Castle) with appurtenances, to hold, together wih all the issues, amercements, profits, advowsons, wardships, reliefs, wrecks of the sea and other things.
green wax = estreats of issues, fines, and amercements in Exchequer and delivered out to sheriffs under the seal of the Court to be levied by them in their counties (Les Termes de la Ley)
Argument whether the king's grant to the duchess granted to her issues and amercements forfeited in the king's court.
arguments whether royal grants in general terms or of uncertain things (e.g. chattels of felons and fugitives) are good.
Tresham: felony may be found before the coroner, or before justices of gaol dellivery, or before justices of oyer and terminer, or before the king in his bench (King's Bench)
Babington CJCP distinguished grants (to a mayor and bailiffs of a town) to hold pleas of all actions, and cognisance of all kinds of pleas
Hals JKB: issues, fines, and amercements, after they are forfeit, are merely chattels in the king, and the king can grant goods and chattels in general terms
King's Sjt Newton: The king has inheritance in issues and amercements, and so they are inheritable
Martin JCP: this word ... unless the meaning forbids it, shall relate to the words immediately preceding
Paston JCP: If every word can by grammatical construction (construccion d' grammar) be construed in one way to the advantage of the king and to the patentee's advantage in another, I say that it is right to construe the words to the patentee's advantage, etc., for no Chancery clerk will arrange Latin words as English words should be arranged, for it is the same here as in a case of the construction of a hymn (ympne) or a sequence (sequens), when one, by way of construction, ought to begin at the end or in the middle and a verb that comes at the end will serve for everything
Cheyne CJKB: when the king's grant can be understood in various respects, it shall be interpreted to the king's greatest advantage, etc. but it is different (MSS: autre; YB: semble) between other persons
Paston JCP: in this case the letters patent can take effect by the actual words contained in them, by clear construction and not by intendment or any subtle matter (plain meaning principle)
Babington CJCP: If, as Vampage AG has said, everything that follows the 'habendum' which is not parcel of the manor should be void, the greater part of patents in England would be void, and I know that the wisest men of law have made patents in such a form before this and they have been held to be good
