Topics in Trademark Law (S)

JD 791 (A1) T 2:10-4:10 3 credits, Fall Professor Dogan

This seminar will explore advanced topics in trademark law, with an emphasis on both doctrine and theory. We will critically examine competing theoretical justifications for trademark law and will consider their implications for a number of important cutting-edge questions, including the scope of trademark rights on the Internet, trademark protection of product design, jurisdictional differences in trademark law and theory, and the debate over whether United States law recognizes rights in well-known foreign marks. No prerequisite. Grades will be based on a series of short papers discussing the weekly topics. Student participation will also be considered. In lieu of these papers, it is possible to write a paper that satisfies the Upper-class Writing Requirement.

A student who fails to attend the initial meeting of a seminar (designated by an (S) in the title), or to obtain permission to be absent from either the instructor or the Registrar, may be administratively dropped from the seminar. Students who are on a wait list for a seminar are required to attend the first seminar meeting to be considered for enrollment.
