This is a course on the civil rights of individuals with disabilities in the United States. As we study the development of disability law in the U.S. through ADA (Americans with Disabilities Act) and other statutes and cases and examine topics such as the definition of disability, mental and physical disabilities, employment discrimination, reasonable accommodation, and disability and education, we will try to consider the evolution of protective and regulative laws in other parts of the world as well. Alongside a doctrinal focus on American disability law, the course will throughout foreground the theoretical justifications and policy implications of integration as well as the economics of accommodation. In line with a human rights approach to disability, we will also look at the international developments in the field and its implications for disability law in the United States and beyond. Evaluation will be based on class participation (20%) and a take-home exam (80%).
