Director's Message

Dear Colleagues and Friends,

In our last Graduate Tax Program Newsletter, I mentioned that I was in the process of transitioning out of my present positions at BU Law in order to undertake new responsibilities here. I am now delighted to report that Daniel M. Berman - a distinguished tax lawyer with impressive public sector, private sector and tax teaching experience - has accepted appointment, as of July 1, 2008, as Professor of the Practice of Tax Law and Director of the Graduate Tax Program.

Dan has worked in both the legislative and administrative branches of U.S. government and brings an unparalleled understanding of the formation and substance of tax law and policy. He served as Deputy International Tax Counsel for the U.S. Department of the Treasury and as Legislative Counsel for the Joint Committee on Taxation of the U.S. Congress.

Dan also has extensive experience in the private sector, having practiced as a Partner with Thelen Reid Brown Raysman & Steiner, LLP, and with Sutherland Asbill & Brennan, LLP, both in Washington DC. He has extensive experience in tax planning, tax controversies, tax policy work and negotiating and interpreting tax treaties.

Dan has taught courses in U.S. and international tax law at the International Tax Academy of the International Bureau of Fiscal Documentation (IBFD) in Amsterdam, as an adjunct professor at Georgetown University Law Center, and as an instructor at Harvard Law School's International Tax Program. He is an elected member of the Council of the International Fiscal Association (USA Branch), served as National Reporter for the IFA and led the first Tax Law Delegation to China with People-to-People International. He is a former co-chairman of the worldwide tax practice group of the TerraLex law firm network, and has served on several advisory boards. Dan also speaks and writes on tax topics. He has been published in numerous tax publications including the Tax Management International Journal, International Tax Review, Taxes and other publications.

While Dan's greatest expertise is in international tax, he expects to continue to strengthen the Graduate Tax Program's curriculum in all tax subspecialty areas, including estate planning and domestic business transactions.

Dan received his J.D., cum laude, from Harvard Law School and his A.B, magna cum laude, from Harvard College where he majored in Applied Mathematics and Economics and was elected to Phi Beta Kappa. He was the recipient of the Endicott Peabody Saltonstall Prize, which is awarded by the Deans of Harvard College and Harvard Law School to the most outstanding senior in Harvard College proposing to enter Harvard Law School. He is a member of the District of Columbia Bar and is admitted to the Supreme Court of the United States, U.S. Court of Appeals, Federal Circuit, U.S. Court of Federal Claims, and the U.S. Tax Court.

I am truly honored to be succeeded in this position by Dan. While I like to believe that our Graduate Tax Program has made great strides forward in the past few years, I am confident that Dan - with his extraordinary background in tax policy, practice and teaching - will lead the Program an even higher level of excellence. I hope and trust that all of you who receive this Newsletter - alumni, tax professors and other friends and colleagues - will welcome Dan to his new position.

In my new position as Associate Dean for Special Projects, I expect to be primarily involved with alumni relations and fund raising as well as other special projects. While my telephone number most likely will change, my new office will be close to the Graduate Tax Program suite and my email address - ehaddad@bu.edu - will remain the same. I hope that you will feel free to stay in touch with me in the future.

Faculty Spotlight: Professor Skip Patton Focuses on International Tax

A 1969 graduate of BU Law, Lecturer in Law Brainard (Skip) Patton is an attorney who has spent his career specializing in international taxation. Immediately after his retirement from PwC four years ago, he thought he was retired-retired. Events took over, however, and he has now found a nice balance by compartmentalizing his professional life into tax consulting, the International Fiscal Association, and the BU Law Graduate Tax Program

The post-retirement consulting part developed almost by accident and he finds himself with a portfolio of sophisticated projects for several large corporations and some high-net-worth individuals. This is partly due to a reputation and trust garnered from many years of publishing and speaking on international tax topics, plus teaching at several institutions over the years. In a counter-intuitive way, not being associated with a major firm has opened up opportunities for several reasons: the work requested is done solely by him because he has no one to leverage to, and because he can work collaboratively with any outside counsel preferred by the client. Having lived twelve years in Paris, Brussels, and London, where he also worked as an international tax lawyer, has given him a unique perspective. Finally, his background in accounting allows him to factor the impact of decisions on reported financial results.

Skip devotes a considerable amount of time to the International Fiscal Association (IFA). With 11,000 members worldwide in over 90 countries and national branches in nearly 50 countries, IFA is a leading non-governmental, international organization dealing with tax matters. Comprised of company tax personnel, lawyers, accountants, university professors, and government officials, it provides a unique forum for discussing international tax questions. In February, Skip was elected president of the USA Branch of IFA, the largest national IFA branch, for a two-year term. The Branch website provides additional information.

The remainder of his professional life is devoted to the Graduate Tax Program at BU Law. As a proud BU Law graduate, Skip is dedicated to promoting the school and its programs. He has been a lecturer in law since 1999 and has created several courses for the GTP, including International Business Planning, International Tax III, and Inbound International Taxation. He also collaborated in designing a curriculum of international tax courses with the objective of educating GTP students to the highest level of practical understanding of international tax law. GTP graduates can now apply for positions with the tax departments of major law or accounting firms with the confidence that they have been exposed to every significant aspect of international tax law. It is, however, in the interaction with the GTP students in the two classes that he is currently teaching that Skip takes the greatest pleasure, vicariously enjoying their successes as well as their challenges as they make the transition from student to practicing tax professional. The fact that many of his students are from other countries provides especial interest for him as he well remembers his own transition from a life in the U.S. life to that of an expatriate in Europe.

In his spare time, Skip works diligently on his golf game, skiing, tennis, running, and especially guitar, as he makes a new transition, this time to jazz from the folk music he played in the late sixties at Brandy’s, Your Father’s Mustache, and the various women’s colleges around Boston.  He lives happily in Duxbury with his wife of 38 years.

Community Tax Aid of Boston – Each year during tax season, the Graduate Tax Program encourages our students to volunteer with Community Tax Aid of Boston, a non-profit organization that helps elderly and low-income taxpayers with their tax returns.  Four GTP students, Rebekah Montague, Elsa Passer, Serena Baig, and Carrie Helmond generously donated their time and experience this year to this worthy cause.    

Tax Attorney Recruiting Event – On February 29, several Graduate Tax Program students traveled to Washington, D.C. for the annual Tax Attorney Recruiting Event (TARE).  TARE is a program run in cooperation with the University of Florida and New York University during which recruiters from law and accounting firms all over the country can interview qualified tax LL.M. students.  Many of our students had upwards of 8 interviews each day, and the connections made in these interviews have greatly helped them in the second semester job search.

Tax Ethics Program – Each year, the GTP holds a tax ethics program in which students have the opportunity to discuss an ethical problem with fellow students and several professors who moderate a panel.  This year’s problem, presented on March 28, focused on an estate planning issue and was moderated by current faculty members Melissa Langa, Jere O’Sullivan and Bob Stewart, former faculty members George Cushing and Ed DiFranceschi, and Richard Murray, who is a Supervisory Attorney at the IRS.  GTP students are required to attend this program, or complete Professor David Casten’s “Standards and Responsibilities in Tax Practice” course before they graduate.

Commencement - On May 18, 2008, the Boston University School of Law held its commencement ceremonies in Agannis Arena. United States Congresswoman and BU Law alumna Niki Tsongas gave the commencement address.

The Graduate Tax Program students who participated in the ceremony were lead by Class Marshall Christopher Bennett. DiAndria Green addressed the thousands of people in the Arena on behalf of all LL.M. graduating students, and Christopher Bird received the Graduate Tax Program Academic Achievement Award.

After the ceremony, graduates were joined by their families and friends at the BU FitRec center for a champagne reception.
