- FLSA position classification (exempt vs non-exempt)—The Fair Labor Standards Act (FLSA) outlines requirements for minimum wage and standards under which employees in executive, administrative, professional, outside sales, and computer positions are exempt from federal overtime pay. Exempt status is determined on an individual basis.
